GeekCast Radio Network, LLC (“GCRN”) respects the intellectual property rights of others and takes copyright compliance seriously. This page explains how to submit a formal copyright infringement notice, how we respond, and how to file a counter-notification if you believe content was removed in error.

How to File a DMCA Takedown Notice

If you are a copyright owner or authorized agent and believe that content on TheGCRN.com or in our podcast feeds infringes your exclusive rights, please submit a written notification to our Designated DMCA Agent.

To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  2. Identification of the copyrighted work claimed to have been infringed (e.g., a link to the original work or registration number)
  3. Identification of the infringing material and its exact location on our network — include the full URL of the specific page, or the podcast episode title and feed where the content appears
  4. Your contact information: name, mailing address, telephone number, and email address
  5. A good faith statement that you believe the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

Incomplete notices will not trigger the statutory removal timeline. Please ensure all six elements above are included before submitting.

How We Respond

Upon receipt of a valid, complete DMCA Takedown Notice, GCRN will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the contributor or user responsible for the content that it has been removed
  • Provide that party with information on how to file a Counter-Notification if they believe the removal was made in error

Counter-Notification Procedure

If your content was removed as a result of a DMCA Takedown Notice and you believe the removal was made in error or due to misidentification, you may file a Counter-Notification under 17 U.S.C. § 512(g)(2)-(3).

Your Counter-Notification must be sent to dmca@GeekCastRadio.com and must include:

  1. Your physical or electronic signature
  2. Identification of the removed material and the location where it appeared on our network before it was removed
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  4. Your name, physical address, and telephone number
  5. A statement that you consent to the jurisdiction of the U.S. District Court for the District of Colorado (Weld County), and that you will accept service of process from the person who submitted the original takedown notice

Upon receipt of a valid Counter-Notification, GCRN will forward it to the original claimant. If the original claimant does not file a federal court action within 10–14 business days, we are permitted to restore the removed material at our discretion.
